Charges involving Minors in Possession Generally come in 4 varieties:
(1) Misrepresentation of age by a minor under ORS 165.805. This is typically charged as a crime and occurs when a person being less than a certain, specified age, the person knowingly purports to be of any age other than the true age of the person with the intent of securing a right, benefit or privilege which by law is denied to persons under that certain, specified age. I.e. using a fake ID to purchase alcohol or cannabis or to get into a bar or nightclub.
(2) MIP Alcohol under ORS 471.430. This is a violation and occurs when a person under 21 attempts or in fact purchases or possess alcohol. Possession can occur even by possession of the alcohol in your own bloodstream which is possession by consumption. There are specific statutory exceptions that can be a perfect defense for this. Most notably, you are immune from prosecution in you contacted emergency medical services or law enforcement in order to obtain medical assistance due to alcohol consumption for you or another person and the evidence of the possession results from that contact. (3) MIP Marijuana under ORS 475B.316. This is a violation and occurs when a person under 21 attempts or in fact purchases or possesses a marijuana item. Possession can occur even by the consumption of a marijuana item anytime within the last 24 hours prior to the determination that the young person consumed the marijuana item. There are specific statutory exceptions that can be a perfect defense for this. Most notably, you are immune from prosecution in you contacted emergency medical services or law enforcement in order to obtain medical assistance due to marijuana consumption for you or another person and the evidence of the possession results from that contact.
