The client was charged with DUI after consenting to Field Sobriety Testing as well as a Breath Test and a Drug Recognition Examination (DRE). The client only consented to the testing after the officer in essence told him that if he did not consent he would be taken to jail. After a hard-fought Motion to Suppress the court agreed that the consent was involuntary and suppressed the results of the testing and the prosecution dismissed the charges.
