DUII and Reckless Driving

Client was stopped after a motorist called 911 because a driver was swerving, fluctuating speeds and almost sideswiped another vehicle.  Client failed all sobriety tests and recorded a blood alcohol content of .18%.  A glass marijuana pipe, a jar of marijuana, dozens of Co2 cartridges and several empty cans of alcohol were found in the front seat of client’s car.  The officer smelled the odor of marijuana from inside the vehicle.  Client was cited for DUII and Reckless Driving, both Class A misdemeanors.  Client was facing 364 days in jail but after negotiations with the prosecutor, we were able to obtain a dismissal of the Reckless Driving, 48 hours jail, 24 months probation, and a fine.
